Acknowledgment
These Terms and Conditions control how this Service is used and make up the agreement in force between you and the Company. In them you will find the rights and obligations that apply to every user of the Service.
To access and use the Service, you have to accept these Terms and Conditions and abide by them. The same rule holds for every visitor, user or anyone else who reaches the Service.
Once you access or use the Service, these Terms and Conditions are binding on you. Anyone who does not agree with some part of them must not access the Service.
You confirm that you are above the age of 18; the Company does not let anyone under 18 use the Service.
You also need to accept and comply with the Company’s Privacy Policy in order to access and use the Service. It lays out our rules for collecting, using and disclosing your personal information when you are on the Application or the Website, along with your privacy rights and the legal protection behind them. Please go through it closely before using the Service.
Links to Other Websites
Links on the Service can lead to third-party sites or services outside the Company’s ownership and control.
The Company does not control those sites or services, including their content, privacy policies and practices, and takes no responsibility for them. You agree that any damage or loss you suffer, or claim to suffer, from using or relying on content, goods or services offered on or through such sites is not the Company’s responsibility, directly or indirectly, and the Company is not liable for it.
Before using any third-party site or service, please look through its own terms and conditions and privacy policy; we strongly encourage this.
Termination
We may suspend or end your access immediately, without prior notice or liability and for any reason, including a breach of these Terms and Conditions.
After termination, you may no longer use the Service, effective immediately.
Limitation of Liability
Regardless of the damages you might incur, the Company’s full liability, including that of its suppliers, under any provision of these Terms is limited to the amount you actually paid via the Service, or 100 USD if you never purchased anything there. That limit is also your exclusive remedy.
Under no circumstances, and to the full extent applicable law allows, will the Company or its suppliers be liable for indirect, consequential, special or incidental damages of any sort. This covers, among other things, lost profits, lost data or other information, business interruption, personal injury and loss of privacy that stem from or relate to using or being unable to use the Service, third-party software and/or hardware used with it, or that otherwise connect to any provision of these Terms. That is true even when the Company or any supplier had been advised that such damages might occur, and even when a remedy fails of its essential purpose.
State law sometimes bars excluding implied warranties or capping liability for incidental or consequential damages, in which case some limitations above may not apply. Where that is the case, the liability of each party is limited as much as the law there allows.
“AS IS” and “AS AVAILABLE” Disclaimer
We offer the Service “AS IS” and “AS AVAILABLE”, with any faults and defects it may have and without warranty of any kind. As far as applicable law allows, the Company, speaking for itself, its Affiliates and the service providers and licensors of each, expressly disclaims any express, implied, statutory or other warranty on the Service. Disclaimed warranties include, for example, those of merchantability and of fitness for a particular purpose, those of title and non-infringement, and any that might follow from how the parties dealt or performed, or from usage or trade practice. Nor does the Company promise, undertake or represent that the Service will do what you need, deliver the results you expect, run alongside any other software, application, system or service, stay available without breaks, reach any standard of performance or reliability, or be free of errors, or that any error or defect is fixable or will get fixed.
On top of that, no representation or warranty of any kind, express or implied, is made by the Company or any of its providers: (i) about whether the Service operates or is available, or about the information, content, materials or products on it; (ii) that the Service will work without interruption or error; (iii) about how accurate, reliable or current any information or content delivered through the Service is; or (iv) that the Service, its servers, its content or the e-mails sent by the Company or on its behalf carry no worms, viruses, malware, trojan horses, timebombs, scripts or other harmful components.
Because some jurisdictions bar excluding certain types of warranties or limiting a consumer’s statutory rights, parts of the exclusions and limits above, or all of them, may not apply to you. Even so, this section is applied as far as applicable law makes it enforceable.
Governing Law
Apart from its conflicts-of-law rules, the Country’s law applies to these Terms and to your use of the Service. Other laws, whether local, state, national or international, may also govern your use of the Application.
Disputes Resolution
For any concern or dispute over the Service, you agree to start by contacting the Company to settle it informally.
For European Union (EU) Users
As a consumer in the European Union, you still get the benefit of any mandatory provisions in the law of the country you live in.
United States Legal Compliance
You represent and warrant two things: (i) the country you are in is neither under a United States government embargo nor designated by that government as a “terrorist supporting” country, and (ii) your name is not on any United States government list of prohibited or restricted parties.
Severability and Waiver
Severability
If some provision of these Terms turns out to be invalid or unenforceable, it will be reworked and read in the way that best serves its purpose under applicable law, while the other provisions keep their full force and effect.
Waiver
Except where these Terms provide otherwise, not enforcing a right or an obligation at a given time never stops a party from enforcing it at any point afterward. Overlooking one breach does not waive any that come after it.
Translation Interpretation
Should a translated version of these Terms and Conditions be offered on the Service, the original English text wins in any dispute, and you agree to that.
Changes to These Terms and Conditions
At any time, and at Our sole discretion, we may revise or replace these Terms. Material revisions come with reasonable efforts on our part to give no less than 30 days’ notice before the new terms start to apply. We alone judge whether a change is material.
Your continued access to or use of the Service after a revision takes effect means you accept the revised terms as binding. If you object to the new terms, wholly or partly, stop using both the website and the Service.
